Terms of Use

1. About these terms

These terms are an agreement between you and Neron LLC ("Neron", "we", "us") about Tolkr, listed on the App Store as "Tolkr: Offline Interpreter". By downloading or using Tolkr you agree to them. If you got Tolkr from the App Store, Apple's standard Licensed Application End User License Agreement also applies; where the two differ, the more specific terms below apply as far as Apple's terms allow.

2. What Tolkr does

• Tolkr helps people who do not share a language talk face to face on one iPhone. Each person speaks in their own language from their own side of the phone, and the other reads and hears it in theirs.
• After a one-time download, it works without an internet connection. Speech recognition, translation and voices run on the phone.
• The free version offers two-person conversation on the phone's own on-device engines. Tolkr Pro adds Doğru mod (Tolkr's own on-device engine) and the other features shown in the app before you buy.
• Tolkr requires iOS 18 or later. Which languages and language pairs work offline depends on what Apple supports on your iPhone.

3. Translations can be wrong

Tolkr is a machine translator, not a professional interpreter. Speech can be misheard and translations can be wrong, incomplete or misleading, even when they look confident. Check numbers, prices, times, doses and names with the other person. For important medical, legal, financial or safety decisions, use a professional interpreter.

You decide what to say and how to act on a translation. Tolkr's features that flag uncertain words or check numbers make mistakes less likely; they do not make them impossible.

4. Who can use Tolkr

You must be at least 13 years old. If you are under 18, a parent or guardian must agree to these terms for you.

5. Downloads and your device

• Doğru mod downloads its models once, about 1.3 to 1.7 GB depending on the phone. The download starts by itself on Wi-Fi and asks before using mobile data. Your carrier's data charges are yours.
• Doğru mod needs a phone with enough memory. On phones without it, Tolkr uses the phone's own engines.
• Some languages need Apple's language files on the phone; iOS downloads them once, from Apple, through its own screen.

6. Tolkr Pro: purchases and subscriptions

6.1 Plans and prices

Tolkr Pro is offered as auto-renewing subscriptions and, where offered, a one-time lifetime purchase. The plans and their prices are shown in the app and in the App Store before you buy. Prices may differ by country, include or exclude taxes as the store decides, and may change; the price the store shows when you buy or renew is the price that applies.

6.2 Taste of Pro

Your first translations run in Doğru mod at no charge, so you can try it before deciding. When they are used up, Tolkr continues on the free engines unless you buy Pro.

6.3 Free trials

A free trial exists only where the purchase screen shows one, and the App Store decides whether you are eligible. When a trial ends, the subscription starts and you are charged unless you cancel at least 24 hours before the trial ends.

6.4 Renewal and cancellation

• Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Your Apple account is charged within 24 hours before renewal.
• Cancel in your iPhone's Settings: tap your name, then Subscriptions. Deleting Tolkr does not cancel a subscription.
• After you cancel, Pro stays on until the end of the period you paid for. The free two-person conversation keeps working after that.
• A lifetime purchase is paid once and does not renew.

6.5 Restoring and refunds

• You can restore a purchase at no cost on an iPhone signed in to the same Apple account, from the Pro sheet in Tolkr.
• Apple processes payments and refunds. To ask for a refund, use reportaproblem.apple.com. Apple decides refunds under its own policy.

7. Using Tolkr fairly

• Use Tolkr lawfully, and respect the people you talk with. Tolkr listens only when someone taps their microphone; let the other person know that a translator is listening.
• Do not use Tolkr to harass, deceive or harm anyone, or to record people where the law does not allow it.
• Do not copy, resell, reverse-engineer or interfere with the app, except where the law allows it.

8. Models and third-party components

• Doğru mod uses openly licensed models, downloaded unmodified from their publishers: Whisper by OpenAI (MIT License), Silero VAD (MIT License) and Tencent Hy-MT2-1.8B (Apache License 2.0). Their licences apply to those files.
• The free engines are Apple's on-device speech recognition, Translation framework and voices, which Apple provides under its own terms.

9. Ownership

Tolkr, its design, code and text belong to Neron. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app. What you say and the translations of it are yours; we never receive them.

10. Disclaimers and limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• TOLKR IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, INCLUDING ANY WARRANTY THAT SPEECH RECOGNITION OR TRANSLATIONS ARE ACCURATE OR COMPLETE.
• NERON IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY DECISION MADE ON THE BASIS OF A TRANSLATION.
• NERON'S TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR TOLKR IN THE 12 MONTHS BEFORE THE CLAIM.

Nothing in these terms limits rights you have under consumer protection laws that cannot be excluded.

11. Changes and ending use

• You can stop using Tolkr at any time by deleting it. Cancel any subscription separately, as section 6.4 explains.
• We may change, suspend or discontinue Tolkr or any of its features.
• We may update these terms. When we do, we change the "Last updated" date above; if you keep using Tolkr after a change, the updated terms apply.

12. Privacy

The Privacy Policy explains what stays on the phone and the few things that go online.

13. General

• If any part of these terms cannot be enforced, the rest stays in effect.
• These terms and the Privacy Policy are the whole agreement between you and Neron about Tolkr.
